1. Introduction and Agreement to Terms

By accessing or using our website (www.itsmodified.com), our print and digital magazine, our online community platform (the “Community Platform”), and our upcoming mobile application (the “App”) (collectively, the “Services”), you agree to be bound by these Terms of Use (the “Terms”), our Privacy Policy, and any other legal notices or guidelines published by us in connection with the Services. 3. Use License (Specific to Website Materials)

Our Services may allow you to submit, upload, post, or otherwise make available content, including but not limited to photographs of your vehicles (“Reader Rides”), comments, forum posts, and other materials (collectively, “User-Generated Content”). You retain ownership of your User-Generated Content. However, by submitting User-Generated Content to our Services, you grant Modified Lifestyle a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sub-licensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display,⁹ and perform your User-Generated Content in connection with¹⁰ the Services and our business, including for promotional purposes.

You represent and warrant that you have¹¹ all necessary rights to grant the licenses in this Section and that your User-Generated Content does not violate any third-party rights, including intellectual property rights, privacy rights, or publicity rights,¹² and is not defamatory, obscene, or otherwise unlawful.

We reserve the right to remove or refuse to post any User-Generated Content for any reason at our sole discretion.

5. Community Platform Guidelines

Our Community Platform is designed to foster a positive and engaging environment for motorsports enthusiasts. By participating in the Community Platform, you agree to abide by the following guidelines:

• Be respectful and considerate of other users.
• Do not post content that is unlawful, harassing, defamatory, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable.
• Do not engage in spamming, advertising, or other unauthorized commercial activities.
• Do not impersonate others or misrepresent your affiliation with any person or entity.
• Do not upload or share malicious software or any other content that could harm our Services or other users.
• Follow any additional rules or guidelines posted within specific areas of the Community Platform.

Modified Lifestyle reserves the right to suspend or terminate your access to the Community Platform for any violation of these guidelines or these Terms.

6. Magazine Subscriptions

Modified Lifestyle offers print and digital magazine subscriptions with various tiers and benefits as described on our website. By subscribing to our magazine, you agree to the subscription terms presented at the time of purchase, including pricing, billing frequency, and renewal policies.

You may manage your subscription through your account settings on our website or as otherwise communicated to you. We reserve the right to change our subscription fees and benefits upon reasonable notice. Modified Lifestyle is developing a mobile application (the “App”) to enhance your experience with our community. The App may include features such as:

• Judging Tools: Functionality for participating in or viewing judging related to vehicle modifications.
• Show Management: Features to assist with the organization and participation in automotive shows and events.
• Other Apps: Additional features and functionalities as developed and made available.

Your use of the App will be subject to these Terms and any additional terms and conditions that may be presented to you upon download or use of the App. We reserve the right to modify, suspend, or discontinue the App or any features thereof at any time.

8. Partnerships

Modified Lifestyle has partnered with Revamp to provide strategic growth resources and exclusive content. While we strive to provide valuable information through this partnership, Modified Lifestyle is not responsible for the services, advice, or outcomes resulting from your direct engagement with Revamp. Any discounts or offers related to Revamp services are subject to Revamp’s terms and conditions.

9. Disclaimer

The materials on Modified Lifestyle’s website are provided on an ‘as is’ basis. Modified Lifestyle makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.¹³

Further, Modified Lifestyle does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to¹⁴ this site.

10. Limitations

In no event shall Modified Lifestyle or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the¹⁵ use or inability to use¹⁶ the materials on Modified Lifestyle’s website, even if Modified Lifestyle or a Modified Lifestyle authorized representative has been notified orally or in writing of the possibility of such damage.
